TERMS AND CONDITIONS OF THE PROMOTIONAL CAMPAIGN ORGANISED

on www.batteryempire.pt

UNDER THE SLOGAN Nova estação, nova energia!

§ 1. DEFINITIONS

The phrases and expressions used in these Regulations shall mean: 

  1. Organiser - CSG SPÓŁKA AKCYJNA with its registered office in Kraków, Kalwaryjska Street 33, 30-509 Kraków, Poland, entered into the register of entrepreneurs of the National Court Register kept by the District Court for Kraków-Śródmieście in Kraków, XI Commercial Division of the National Court Register, under the number: 0000714229, NIP: 6793163992, REGON: 3692932 69,share capital: PLN 350,000.00, fully paid. Correspondence address: Kalwaryjska Street 33, 30-509 Kraków, e-mail address: [email protected];

  2. Store Battery Empire - an online store operating at https://batteryempire.pt/;

  3. Goods - electronic equipment and consumer electronics, in particular under the Green Cell brand, offered for sale in the Battery Empire Store;

  4. Promotional Campaign - promotional campaign organised by the Organiser in the Battery Empire Store under the sloganNova estação, nova energia!, as part of which the Customer making a purchase in the Battery Empire Store receives a discount, pursuant to the provisions hereof; 

  5. Customer - a natural person who participates in the Promotional Campaign;

  6. Regulations - these Regulations which stipulate the rules of conducting the Promotional Campaign, in particular the rules of receiving a discount by the Customer.

§ 2. GENERAL PROVISIONS

  1. The Promotional Campaign runs from 26 May 2022 (at 9:00 am) to the end of 15 June 2022 (to 11:59 PM).

  2. The benefits available under the Promotional Campaign are indicated in § 3 of the Regulations.

  3. Participation in the Promotional Campaign is voluntary.

  4. The Promotional Campaign applies only to purchases made in the Battery Store during its duration.

  5. Goods covered by the Promotional Campaign cannot be reserved in the Battery Empire Store, either online or by telephone. 

§ 3. PROMOTION PRINCIPLES

  1. As part of the Promotional Campaign, the Customer may purchase the indicated Goods at a reduced price.

  2. All Goods available under the Promotional Campaign can be found at: https://batteryempire.pt/146-para-bicicletas-eletricas and are marked as follows: "-5% with code: EBIKESALE", "-10% with code: EBIKESALE", "-15% with code: EBIKESALE", "-20% with code: EBIKESALE".

  3. As part of the Promotional Campaign, each Customer can purchase any number of Goods covered by the Promotional Campaign, subject to § 3.4. 

  4. The number of Goods participating in the Promotional Campaign is limited. The Promotional Campaign lasts until stocks are exhausted.

  5. The promotional price is taken into account only when the Customer uses the discount code provided on the website batteryempire.pt. From 26 May 2022 (at 9:00 am) to end of 15 June 2022 (to 11:59 PM)  there are  5, 10, 15 i 20% discounts with the code “EBIKESALE” for selected products from the list of products covered by the promotion.

  6. The Promotional Campaign is combined with other promotions organised by the Organiser. 

§ 4. RETURN AND EXCHANGE OF GOODS

  1. Goods purchased by the Customer shall not be subject of return or exchange, unless a justified complaint about the Goods has been reported in accordance with the applicable provisions of the applicable law concerning legal warranty, if a defect in the Goods is found or a statement of withdrawal from the contract has been made (applies to contracts concluded via the online shop https://batteryempire.pt/).

  2. The provisions of these Terms and Conditions do not violate or limit the right of complaint related to the warranty or guarantee or other generally binding legal regulations.

§ 5. COMPLAINTS 

  1. All possible complaints connected with the course of the Promotional Campaign may be reported by the Customer within 30 days from the date of purchasing the Goods or attempting to purchase the Goods. 

  2. The complaint should be addressed to the Organiser in writing, preferably by registered mail, to the Organiser's address or e-mail address specified in §1 of the Regulations, with the annotation Nova estação, nova energia!.

  3. The complaint shall contain the name and surname, the Customer's correspondence address and a description of the circumstances giving rise to the complaint. 

  4. The Organiser shall consider the complaint within 14 days of its delivery. The Customer will be notified of the result of the complaint examination by registered letter sent to the correspondence address or e-mail address indicated by the Customer in the complaint.

§ 6. PROCESSING OF PERSONAL DATA

  1. The administrator of the Customers' personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and other relevant laws. ("RODO") is the Organiser - CSG SPÓŁKA AKCYJNA with its registered office in Kraków, ul. Kalwaryjska 33, 30-509 Kraków, Poland, entered in the register of entrepreneurs of the National Court Register, kept by the District Court for Kraków-Śródmieście in Kraków, XI Economic Division of the National Court Register, under KRS: 0000714229, NIP: 6793163992, REGON: 369293269, Share capital: PLN 350,000.00, fully paid up. Address for correspondence: Kalwaryjska Street 33, 30-509 Kraków, e-mail address [email protected],

  2. Provision of personal data is voluntary, but failure to do so will prevent participation in the Promotional Campaign.

  3. Customers' personal data will be processed on the legal grounds set out below, for the following purposes and until the expiry of the following periods: 

a) on the basis of Article 6 (1) (a) RODO, in order to enable participation in the Promotional Campaign, conducting and dispatch of Goods, handling of returns and processing of complaints, until the expiry of the period of limitation of claims of Customers related to participation in the Promotional Campaign, and in the case of granting by the Customer of an additional, optional consent, also for marketing purposes until withdrawal of such consent, 

b) on the basis of Article 6 (1) (f) of the RODO for the purposes resulting from the legally justified interests pursued by the Organiser, including for the purposes of making settlements and pursuing claims, 

c) on the basis of Article 6 (1) (c) of the RODO for the purpose of fulfilling the Organiser's legal obligations consisting in proper tax settlements and correct bookkeeping for the period required by the provisions of the said Accounting Act. 

  1. By making an application for the Promotional Campaign, the Customer consents to processing of the personal data provided by him/her in connection with participation in the Promotional Campaign by the Organiser in order to enable participation in the Promotional Campaign, its running and settlement, including issuance of the Goods and processing of complaints, for the aforementioned purposes resulting from legally justified interests pursued by the Organiser, including for the purposes of making settlements and pursuing claims, as well as for the aforementioned purposes of fulfilling the Organiser's legal obligations concerning correct tax settlements and correct bookkeeping of accounts.

  2. The basis for the processing of personal data is the voluntary consent of the person to whom the data pertains, its lack prevents participation in the Promotional Campaign. The processing of personal data in the course of the complaint procedure takes place on the basis of a legally justified interest of administrator, i.e. for the purpose of examining the demands of the complaint in order to resolve them at an extrajudicial stage. 

  3. Customers' personal data will be processed for the duration of the Promotional Campaign, and after its termination for the time connected with the expiry of claims related to the Promotional Campaign and the sales contract concluded, as well as for the time specified by tax and financial reporting regulations.

  4. Data will not be transferred to a third country (a country outside the European Economic Area (EEA)). 

  5. Data subjects have the right to access their personal data, to demand their rectification, amendment, erasure, restriction of their processing, to object to their processing and to demand their transfer. Such persons also have the right to withdraw their consent to the processing of their personal data at any time, which does not affect the legality of their processing, which was performed on the basis of their consent before its withdrawal. 

  6. The Customer has the right to lodge a complaint to the President of the Office for Personal Data Protection.

  7. The processing of data will not be subject to automated decision-making, including profiling, as referred to in Article 22 (1) and (4) of the RODO. 11.

§ 7. FINAL PROVISIONS 

  1. The basis for the conduct of the Promotional Campaign shall be the provisions of these Terms and Conditions and the applicable provisions of law. 

  2. Any disputes arising from these Terms and Conditions shall be settled by the competent Court.

  3. The Regulations are available in the Battery Empire Store , on the website https://batteryempire.pt/content/60-regras-de-acao and at the organiser's headquarters.

  4. These Regulations shall enter into force on 26th May 2022.
